Terms of Service

Welcome to Smart Prompt Studio ("the Service"), presented by Smart Prompts For AI ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.

1. The Service

Smart Prompt Studio generates AI prompts based on descriptions you provide. The Service operates on a credit system: one credit is consumed per generation or per refinement. Credit allotments depend on your plan.

2. Accounts

You must provide accurate information when creating an account and are responsible for all activity under it. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. Keep your login credentials secure; notify us of any unauthorized use.

3. Plans, Billing, and Credits

Paid subscriptions (monthly or yearly) and one-time lifetime purchases are billed through Stripe. Subscription credits reset on the 1st of each month and unused credits do not roll over. Lifetime plans are a one-time payment granting a recurring monthly credit allotment for as long as the Service operates. We may change pricing for new purchases at any time; active subscriptions are notified before any price change takes effect. Charges will appear on your card statement from Smart Prompts For AI.

4. Cancellations and Refunds

You may cancel a subscription at any time. Upon cancellation, you retain access and credits through the end of your current billing period, after which your account reverts to the free plan. All payments are non-refundable, including lifetime purchases, except where required by law or at our sole discretion in exceptional circumstances.

5. AI-Generated Content

Prompts are generated by artificial intelligence and are provided "as is." We do not guarantee that generated content is accurate, complete, or fit for any particular purpose. You are responsible for reviewing outputs before use. To the extent permitted by law, you own the prompts generated from your inputs and may use them for any lawful purpose.

6. Acceptable Use

You agree not to use the Service to generate content that is unlawful, infringing, or harmful; attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; resell or redistribute the Service; or circumvent credit limits, including by creating multiple free accounts. We may suspend or terminate accounts that violate these terms.

7. Intellectual Property

The Service, including its software, design, templates, and branding, is owned by Smart Prompts For AI. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

We may suspend or terminate your access for violation of these Terms. You may delete your account at any time by contacting us. If the Service is discontinued, we will provide reasonable advance notice to active paid users.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which Smart Prompts For AI resides, without regard to conflict of law principles.
